1. Promotion conditions

Article 1.1: Definitions

  • Promotion: Marathon Runner
  • Participant: a natural person of 10 years or older who participates in the Promotion.
  • Campaign Period: from 1 August 2023 to 15 October 2023 inclusive.
  • Participation: Submitting the score of at least one game.
  • The Organization: Tata Consultancy Services, Le Champion and Mizuno Corporation
  • The Website: marathonrunnergame.nl
  • Prizes:
    • A VIP treatment at the TCS Amsterdam Marathon on October 15, 2023 including:
      • Access to the hospitality area of Mizuno (including catering and changing facilities)
      • A Mizuno race kit (shirt, shorts, socks)
      • A pair of the Official Mizuno Wave Rider 27 Amsterdam running shoe
      • The Official Mizuno Race Shirt
      • A bib number by choice for race day
      • A post-race massage in the Mizuno area
    • Weekly prizes from Mizuno and Le Champion, communicated weekly, for the weekly highest score.
  • General conditions: these terms and conditions.

Article 1.2: Applicability

  • These General Terms and Conditions apply to the Promotion and the Participation therein by all Participants.
  • The applicability of any other (general) terms and conditions is expressly rejected.

Article 1.3: Promotion

  • Participants can participate from Tuesday, August 1 through Sunday, October 15. They do this by submitting one or multiple scores after playing the game.
  • Participation must meet the requirements set out in these Terms and Conditions or in other applicable documents. The Organization may provide further information about the respective Promotion. This information, including additional terms and conditions, must be read carefully by the Participant and complied with at all times.
  • The Organization reserves the right at any time to refuse Participants and change or cancel the Promotion.
  • It is not possible to correspond with the Organization about the results and/or the assessment of the Promotion.

Article 1.4: Course of the Promotion

  • Participation is possible from August 17, 2023.
  • Each week, the weekly highest score wins a Mizuno prize which will be announced each week;
  • Participants can win a weekly prize only once. After this, they can still compete for the grand prize.
  • The prize winner of the VIP treatment at the TCS Amsterdam Marathon must be at least 18 years old. If not, the prize will be advanced to the next highest score.
  • If a prize winner does not respond within 5 days, the Organization reserves the right to approach someone else.
  • Other expenses cannot be recovered from the Organization.

Article 1.5 Prizes

Prizes cannot be exchanged for cash or other goods and services. Expenses incurred by the Participant in connection with the prize cannot be recovered from the Organization.

Article 1.6 Prohibited information

Participant guarantees that the Participant’s Submission is correct and complete and in any case does not contain the following information:

  • Information contrary to morality;
  • Information in which personal data of others are made available;
  • Information in violation of any law or regulation.

Article 1.7 Liability

  • Neither the Organization, nor any of its affiliates, nor its members or employees assumes any duty of care, responsibility or liability of any kind, whether in contract tort or otherwise, for any damages, whether direct, indirect or consequential, in connection with Participant’s Participation in the Promotion, access and use of the Website, any statements made concerning the Promotion and the Website, and any results arising out of the Promotion.
  • Participant indemnifies The Organization for any claims by third parties in connection with damage resulting from a defect/fault of the participation (content/form), use of certain materials without the consent of third parties and all other claims of third parties regarding the content and form of the Submission.

Article 1.8 Others

  • At the request of the Organization, the Participant must be able to identify himself with a valid ID.
  • If it appears that the information provided by a Participant is incorrect, the Organization has the right to exclude the Participant in question from Participation in the Promotion. and/or may decide to forfeit the right to collect the Prize.
  • In the event of reasonable suspicion of undue influence on the Promotion, abuse or fraud, The Organization reserves the right to refuse Participation or Participants in the Promotion or to forfeit the right to a Prize (retrospectively).
  • All intellectual property rights relating to texts, images, layout, software or other information relating to this Promotion and which may be used during the Promotion shall belong to the Organization.
  • Printing, spelling, typesetting or similar errors cannot be invoked and in no way constitute an obligation on the part of the Organization.
  • In cases not provided for in these Conditions of Action, the Organization shall decide unilaterally. A unilateral notice about this will be provided to the Participant(s).
  • The Organization reserves the right to change the Terms and Conditions in the interim and/or to terminate the Promotion early if it sees good reason to do so.
  • The Promotion, the Participation therein and these Terms and Conditions shall be governed by Dutch law. Any disputes or claims arising therefrom shall be submitted exclusively to the competent court in Rotterdam (the Netherlands).

 

2. Processing of personal data

  1. For the Promotion “Marathon Runner” the Organization has entered into a cooperation with Techonomy B.V. As part of this cooperation, Techonomy processes this data.
  2. The data collected are:
  • Name – to personally address participants in an email;
  • Email address – for proper follow-up with Marathon Runner.
  • Age – to determine eligibility for the VIP treatment at  the TCS Amsterdam Marathon.
  • Score – to help determine who prize winners are.

  2. By agreeing to these Terms and Conditions, personal data of the Participants to execute the Participation and to inform the Participants about relevant matters concerning the Campaign.
